Indeed. Now see why the COPPA is important? People actually do care about it.
You have to have a pretty extreme violation involving personal information to be prosecuted, however.
If you read the article, all they are getting in trouble for is not making sure the under 13 year-olds had parental consent. As long as you don't allow members under 13 to sign up or have a check box that says they got parental consent if they are under 13, you should be fine.

Well yeah, that was the implication I was attempting to make.
wow, this is an intersting coicidence. I never had a 13 age problem (but then again, I was 13 before I really started web surfing).
