This is crazy! I just received a phone call from a high school buddy a few minutes ago alerting me to this... You have to admit, the similarities are pretty striking. And the footage is shown in the same context! I didn't see one dime from Sony. Grrr... Grrr...

... I fail to see any similarity other than the choice of music, unless you expect all consoles to never showcase more than one game in a commercial. They presented their games in a totally different manner than you did as well, linking them all together, bursting out of the console, etc.


Not to mention ripping off that entire song is borderline breaking copyright law, you're the one that should be sued :)

I'd like to mention the shadow of a possibility that DigiTan may not be entirely serious in his righteous indignation or genuinely planning to sue Sony. I mean, that's pretty unlikely, given that he's never been anything less than deathly serious before, but I'd thought I'd put this out there anyway.

And I'll mention that although my post is worded as to talk to digitan directly, I'm really commenting on the slew of "sue them" comments that came after his post.

Unless all those other posts were sarcastic and the internet failed conveying it to me.

cause if you didnt then technically
they can copy it.
but the music , the way they
put it and the starting seconds
do have a striking simularity.
trying to have world peace
you should talk with sony and see if
they did anything?
if they say oh yay. then ask
for some mula if they say they watched
and copied. of course their going to say no though

@JoeImp: The concept--the biggie here--is what they 'stole' more than anything else. Other than that of the music.

Ah, you caught me. I made 5 posts in this topic about the two videos, without ever watching the two videos.

You know what I meant. I don't see anything similar between the two videos that isn't similar with every music video about console games ever made.

Maybe if they did a music video, using the same music, featuring the same calculator games, in the same order, THEN they would be close to infringing on copyright. And even then, I bet they could almost copy it exactly and still get away with it, as putting music to a video demonstrating games like that is too obvious an expression to even be copyrightable.

Not to mention two people can express the same idea, separately, and each is still just as copyrighted, even though they express the same thing. There is no way to prove that Sony viewed this one random video and explicitly copied it.

So pretty much there is not a single aspect of copyright law that this commercial violated.

Which is why the lawyers that know the law and which they pay millions of dollars allowed this commercial to be made and aired.
